Terms and Conditions

Purpose, Scope and Output of the Engagement:

The costs cited in this proposal are valid for 14 days from date of issue and are based on the information provided. If additional information is forthcoming, the project specification changes, Lucas Brand Strategy & Design Pty Ltd’s (LBSD) role in the project changes or the scheduling changes and it is outside of LBSD's control, costs will change. If this was to eventuate LBSD will treat and quote additional information as a separate job. Any additional out of pocket costs such as external scanning, photography, and or the purchase of stock photographs will need to be incurred directly by the client. We will advise you of the costs and will not place any orders without the client’s knowledge and approval. All associated expenses including administration costs, materials and freight costs incurred by LBSD during the creation of work for this project will be charged to the client in our final invoice for the project. Our terms are one third of the total estimate costs in advance. One third of the total estimate costs upon acceptance of the design concept, which will need to be finalised within 14 days from date of invoice. Ownership

By accepting LBSD‘s design proposal and quote, the client agrees to all the terms and conditions of LBSD as stipulated below. All concepts and materials used in the production of the tasks LBSD undertakes - including original and computer generated artwork - remain the property of LBSD The client acknowledges that LBSD will own all intellectual property rights to any work LBSD creates and upon finalisation of our invoices LBSD will assign usage rights of our concept and artwork to the client of the proposed project for the specific purpose/use of the project as outlined in our proposal. Ideas and concepts which are not accepted remain the property of LBSD and may be used in the future in the course of other assignments. If Lucas is not engaged to work on the project further all intellectual property associated with the presentation remain the property of LSBD. Lucas Brand Strategy and Design Pty Ltd own the rights of all designs in this document. These designs cannot be used without payment or engagement.

Responsibilities

We will not be responsible for the correctness of content. LBSD will not be held accountable for the role of any contractor’s or third parties. LBSD will not be accountable for any delays in production. The client acknowledges that the usage of any material purchased by LBSD on behalf of the client and or material provided to LBSD by the client is the sole responsibility of the client. The client indemnifies LBSD against all loss, costs and damages arising out of the infringement of any third party’s intellectual property rights of any material included in work produced by LBSD at the instruction of the client. Timings are estimate only. LBSD reserves the right to terminate the contract after any completed stage.

Fees

The fee arrangement is based on the expected amount of time and the level of staff required to complete the specified services as agreed. The fee is excluding miscellaneous expenses which are incurred to complete the engagement. This fee arrangement will be subject to change if the following circumstances should occur: any requests for items outside the defined scope, authors requests from the client, or any additional rounds of design development will incur additional costs. Proposal fees are cost estimates only. LBSD reserve the right to stop working on the project after the completion of an individual stage. Invoices must be paid 30 days after issue date. Costs and timings are estimate only. Authors corrections will incur additional costs. Requests for additional concepts will incur additional costs.
